Terms of Service

These Terms of Service ("Terms") govern your access to and use of Monumize, LLC's website at monumize.com and any related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.
1. Who can use Monumize
You must be at least 18 years old and able to form a binding contract under the laws of your state. If you are using the Service on behalf of a business (a monument dealer or cemetery), you represent that you have authority to bind that business.
2. The Service
Monumize is an AI-assisted marketplace that connects:
- Caretakers (families) who want to add an inscription to an existing headstone;
- Monument dealers who perform the engraving; and
- Cemeteries that may refer caretakers to the platform.
We are not a monument dealer. We do not cut or engrave stones. The cutting and physical work is performed by the dealer assigned to your job. The dealer is the seller of the inscription and warrants the work product.
3. Your account
- You are responsible for keeping your password secret and your account details current.
- You may not share your account or impersonate another person.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users.
4. Using the Service responsibly
You agree NOT to:
- Submit content you don't have the right to upload (photos, names, inscriptions).
- Submit hateful, defamatory, or unlawful inscriptions.
- Attempt to reverse-engineer, scrape, or stress-test the Service.
- Probe other users' data or attempt to defeat our access controls.
- Use the Service to violate any state monument-dealer licensing law.
We may remove content or terminate access for violations.
5. Pricing and payment
- The price of each job is set by the dealer who claims it. Monumize charges a 10% platform fee on top of (or out of) that price; see the per-job summary on the checkout page for the exact breakdown.
- Payment is processed by Stripe under their terms. By paying you also agree to Stripe's Services Agreement.
- For marketplace payments, Monumize uses Stripe Connect destination charges: Stripe deposits the dealer's net into the dealer's connected account on Stripe's normal payout schedule, and the platform fee comes to Monumize automatically.
- Cemetery referral fees (when applicable) are transferred from Monumize to the cemetery's connected account after payment captures.
6. Refunds and disputes
- Once you approve a proof and the dealer begins production, refunds are at the dealer's discretion subject to applicable consumer protection law.
- Before the dealer begins production (status
paidbut noin_productionevent), you may request a refund through support. - For chargebacks, Stripe's dispute process applies. Monumize will cooperate and provide signed-proof artifacts as evidence.
7. AI-generated content
- The proof image you approve is generated by an AI model based on your photo and inscription text. We mark every AI-generated image as such in the app and in completion emails.
- The AI may be wrong. You are responsible for reviewing the proof before approval. Once you sign, the proof is the source of truth for what gets cut.
8. Your content; license to operate the Service
You retain ownership of the photos and inscription text you upload. You grant Monumize a worldwide, royalty-free license to use, store, copy, transmit, and display your content only as needed to operate the Service (for example, sending the photo to the assigned dealer, generating an AI proof, building a DXF file). We do not use your content for marketing without separate, explicit consent.
9. Dealer and cemetery responsibilities
Dealers and cemeteries operate under separate written agreements with
Monumize (see dealer-agreement.md and cemetery-pilot-agreement.md).
Those agreements control as between Monumize and the business; these
Terms control as between Monumize and the individual user.
A dealer claiming a job represents that they hold a current and valid monument-dealer license in the state(s) where they will perform the work.
10. Intellectual property
The Monumize brand, software, and original UI elements are owned by Monumize, LLC. The fonts shown in the picker are presented for selection only; the dealer is responsible for using a properly licensed monument font when cutting.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONUMIZE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MONUMIZE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
THE INSCRIPTION ITSELF IS WARRANTED BY THE DEALER, NOT BY MONUMIZE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONUMIZE'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID THROUGH THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM AND (B) ONE HUNDRED US DOLLARS (US $100).
13. Indemnification
You will indemnify and hold harmless Monumize from any claim arising out of your content, your violation of these Terms, or your violation of applicable law.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws principles.
Any dispute will be resolved in the state or federal courts located in Fayette County, Kentucky, and you consent to personal jurisdiction there.
(If a binding-arbitration clause is desired, the lawyer should add a standard AAA consumer-arbitration provision here, with a 30-day opt-out period, before publication.)
15. Changes
We may update these Terms. Material changes will be posted at this URL and notified via email to active users. Continued use after the effective date of an update constitutes acceptance.
